Ulmer Partner Frances Floriano Goins and Associate Michael Davis Hoenig recently wrote an article for Bloomberg Law entitled, “Getting Ready for Ohio’s New Data Protection Act.” The Act, which becomes effective November 2, seeks to provide a legal safe harbor to businesses that implement a specified cybersecurity program by providing compliant businesses with an affirmative defense to tort actions brought under Ohio law or in Ohio courts.
