Shana Ortiz See

Shana is an experienced litigator who focuses her practice on product liability litigation and the defense of pharmaceutical, medical device, and mass and toxic tort claims. She has deep experience defending complex product liability cases pending across the country, including matters involving breach of warranty, lemon law, indemnification, and product and structure fires. She coordinates local counsel assisting in cases nationwide, and interfaces with clients including in-house lawyers and engineers. She participates in all stages of litigation, including pleadings and motion practice, expert and lay witness depositions, trial, and appeal. Shana has served as first chair in numerous bench and jury trials across Ohio as well as in other states. In addition to product liability cases, Shana has experience defending managed care plans in provider claims and contract disputes, including arbitrations. She also has experience defending various commercial litigation and state and local taxation matters. She is fluent in Spanish.

Experience

  • Deep experience serving as national product liability counsel for major manufacturers in cases pending across the United States involving torts, warranty, lemon law, indemnification, and product and structural fires.
  • Active in all phases of state and federal litigation, including pleadings, motion practice, discovery, trial preparation, trial, appeal, final case resolution, and temporary and permanent injunctive relief.
  • Skilled in developing experts in multiple areas of expertise, and implementing strategies to exclude or limit expert testimony through motions and hearings pursuant to Daubert, Kemp, and similar expert admissibility standards.
  • Collaborates with business personnel and in-house counsel to develop and implement overall case strategy, including assessment of risk and mitigation of damages.
  • Works with in-house personnel on internal investigations, including recalls.
  • Experienced with pattern fire litigation and served as lead national trial counsel for a major automaker in litigation involving fire-related defects.
  • Trained in fire origin and cause investigations, including graduating from “fire school” catered to technical experts.
  • Managed and participated in litigation involving payer-provider contract and payment disputes, including large scale arbitrations.
  • Extensive experience in various state and local taxation matters and other consumer-related litigation.
