Joshua focuses his practice on product liability litigation. His practice involves the defense of pharmaceutical, medical device, and mass and toxic tort actions. He also is engaged in complex business litigation. He represents major corporations in multidistrict, coordinated, and consolidated proceedings, as well as putative class actions and “one-off” product liability suits. Joshua has been named to the Ohio Super Lawyers list.

REPRESENTATIVE EXPERIENCE

  • Represented medical device manufacturer on claim alleging product defect in spinal fixation device.
  • Represented dialysis center in medical malpractice wrongful death actions.
  • Represented manufacturer of isocyanate-containing products in defense of putative class action for alleged damages arising from alleged occupational exposure to diisocyanates.
  • Defended toxic tort, fraud and civil conspiracy claims against chemical manufacturers based on alleged occupational exposure to vinyl chloride.
  • Represented manufacturers of silica-, asbestos-, and diisocyante-containing products.
  • Represented automobile manufacturer in alleged design defect claim arising out of a rollover accident.
  • Represented former owner of foundry for employer intentional tort and joint venture claims arising from a magnesium explosion.
  • Defended workplace intentional tort claim where employee plaintiff failed to follow workplace safety lock-out and tag-out procedures.
  • Represented automobile manufacturer in negligence claim arising out of plaintiff’s truck allegedly rolling over after being loaded with vehicle parts at manufacturer’s facility.
  • Defended subrogation claims brought by insurance companies arising out of vehicle, forestry equipment and structure fires.
