Kevin M. Bandy

Kevin concentrates his practice on defending product liability litigation and pharmaceutical, medical device, and mass tort claims. He represents a diverse array of clients in multidistrict, coordinated, and consolidated proceedings, as well as putative class actions and “one-off” product liability suits. He has experience with all aspects of complex litigation and has represented clients in multiple state and federal jurisdictions nationwide, including multidistrict litigation involving thousands of plaintiffs. He has researched and drafted numerous procedural and substantive pleadings, such as summary judgment motions, oppositions to motions for class certification, and appeals.

REPRESENTATIVE EXPERIENCE

  • Handles all aspects of federal and state civil litigation, including discovery, motion practice, trial preparation, and appeals.
  • Drafts and researches memoranda and pleadings, including motions to dismiss, discovery motions, dispositive motions, motions in limine, Daubert motions, complex procedural motions, and appellate briefs.
  • Takes and defends depositions in local, national, and international contexts.
  • Effectively and efficiently handles pretrial discovery, including the management of large-scale electronic discovery in product liability matters.
  • Performs advanced legal research and analysis on a variety of complex topics.
  • Worked as part of a team that represented a multinational corporation in a federal MDL involving the complex personal injury and wrongful death cases of over 7,500 individual plaintiffs with claims brought under the Alien Tort Statute, Anti-Terrorism Act, and foreign law.
  • Represented successors-to-interest in various asbestos-related tort claims in state courts.
