Heath Eby


Heath focuses his practice on the resolution of complex business disputes and is prepared to assist clients with their business litigation needs. His broad experience with the litigation process includes pleadings and motion practice, pretrial discovery, and trial preparation. Heath has experience with a wide array of corporate and financial actions, assisting with contract disputes, corporate governance issues, and investment matters.

  • Prepares various pleadings, discovery, dispositive motions, and other documents filed in state and federal courts.
  • Drafts and responds to discovery requests, including requests for production of documents, interrogatories, and 30(b)(6) deposition notices.
  • Assists with depositions by preparing questions, collecting relevant documents, and summarizing deposition testimony.
  • Conducts research and drafts memoranda analyzing a broad range of complex legal issues, including corporate governance, commercial leasing and eviction, contract provisions, state and federal procedural issues, and employment and labor matters.
  • Helped draft a motion for summary judgment on behalf of a self-directed IRA custodian against customer claims of breach of contract and Ohio securities laws, fraud, and unjust enrichment, among others.
  • Successfully represented the directors of a family business in a corporate governance action and obtained dismissal of the case on motion.
  • Previously served as an extern to Judge Dan Aaron Polster of the U.S. District Court for the Northern District of Ohio.
