Representative Experience
  • Has defended numerous national broker-dealer firms and their brokers in federal court litigation and NASD and NYSE arbitrations regarding customer disputes.
  • Has represented national broker-dealer firms and brokers  during SRO investigations and state administrative investigations resulting from customer complaints.
  • Defended bank against claim of breach of fiduciary duty in handling trust accounts.
  • Defended a large multinational manufacturing company against breach of warranty claims and alleged business loss damages exceeding $6.7 million.
  • Defended multinational manufacturing company against Magnuson-Moss Warranty Act claims.
  • Successfully defended numerous insurance cases regarding coverage issues arising under CGL, business auto, and umbrella policies. (For example,  Reinhart v. Mayes, 2004-Ohio-2527, and Gentile v. Indemnity Ins. Co. of North America, 2003-Ohio-5647 (dismissed after remand).)
  • Successfully  represented insurance company  on appeal regarding claims of bad faith refusal to complete pollution remediation (A.J. Hall, Inc. v. Federated Mut. Ins. Co., 1996 Tenn. App. LEXIS 40).
  • Has represented numerous companies against claims alleging discrimination, defamation, wrongful discharge and breach of contract.  (For example, Evans v. Amcash Mortgage Co., 1997 Tenn. App. LEXIS 535.)
  • Successfully litigated and obtained specific performance regarding a publicly traded company's claim of right of first refusal to purchase real estate under a lease agreement.
  • Has represented  numerous builders, contractors, and architects in breach of contract and defective construction claims.
  • Has successfully represented individuals in tort cases involving wrongful death and personal injury, including claims against the United States under the Federal Tort Claim Act.
  • Successfully represented administratrix of estate regarding fee dispute (In the Matter of Estate of Jeffrey Lee Stout, 1994 Tenn. App. LEXIS 345).
  • Experienced in defense and management of complex product liability litigation.
  • Acted as chief assistant to independent counsel for the National Horse Show Commission and conducted independent investigation of alleged improprieties in the Tennessee walking horse industry.
  • Was member of the defense team representing shipping company against civil and criminal claims stemming from the grounding of the Exxon Valdez.
