We have frequently provided our durable medical equipment clients, our physician and physician-group clients, our billing company clients, our emergency room clients, our hospital and other health care provider clients counseling on the compliance guidelines of the Office of Inspector General for Health and Human Services for pharmaceutical manufacturers, durable medical equipment suppliers, physicians and physician groups, billing companies, and joint ventures.
We advise our clients on the Stark laws and state self-referral laws, federal and state anti-kickback and fraud and abuse laws, HIPAA and other federal and state privacy laws, federal and state false claims laws, EMTALA, anti-trust laws, Medicaid and Medicare audits, reimbursement regulations, including late-payment, reassignment and medical necessity issues. We have prepared HIPAA privacy policies for our clients and various HIPAA manuals with prescribed forms for addressing various HIPAA regulatory requirements. We have also prepared, reviewed and provided counsel on various HIPAA business associate agreements and sub-contractor agreements. We have also counseled clients on compliance requirements in connection with the HIPAA security regulations. We help our clients create compliance plans and to implement them and work with our clients to train key personnel to understand, enforce and abide by these laws.
