Members of our group serve creditors (secured and unsecured), debtors, trustees and others in restructurings, out of-court work-outs, bankruptcies, receiverships and other insolvency proceedings. Partners Richard G. Hardy and Michael S. Tucker are both board certified in business bankruptcy law by the American Board of Certification. Partners and counsel group members have appeared in every bankruptcy court in Ohio, as well as in bankruptcy courts in Delaware, Illinois, Indiana, Kentucky, Michigan, New York and Pennsylvania.
We represent secured parties and judgment creditors by filing enforcement actions such as receiverships, foreclosures, involuntary bankruptcies and similar collection proceedings. We also recognize that significant business opportunities can be present in insolvency proceedings, and we regularly assist clients in acquiring and selling assets of distressed businesses through proceedings such as secured party sales and sales under Section 363 of the Bankruptcy Code.
Financial restructurings and insolvency matters give rise to complicated issues which can affect our clients’ strategies and decisions. To meet these needs, the corporate restructuring and creditors’ rights practice group draws on the experience and expertise of members of other groups within the Firm who practice in areas such as banking, litigation, real estate, tax and mergers and acquisitions.
