At a Glance

Rex’s practice largely concentrates on defending mass torts involving pharmaceutical products and dietary supplements.  He also offers his services as a mediator (see Littrell, Rex Mediator BIO.pdf) in cases involving both simple and complex legal matters.  Rex has served as national counsel for a dietary supplement manufacturer and national counsel for a major dietary supplement retailer in products liability litigation throughout the United States in both federal and state courts.  He has extensive mediation experience in mass tort litigation and in guiding companies through such litigation in a bankruptcy context.  Rex has acted as defense liaison counsel in multidistrict litigation and in global mass tort mediations. He also represents the manufactured homes industry in Ohio and, in that role, has extensive experience in zoning and commercial litigation as well as in the drafting and passage of numerous pieces of legislation.  Finally, he is experienced in all phases of commercial/business litigation and employment litigation.

Other Experience
National defense counsel for dietary supplement manufacturer and dietary supplement retailer in ephedra litigation throughout the United States.

Currently serves as court-appointed Defendants’ Liaison Counsel and is a member of Defendants’ Coordinating Counsel in the Ephedra MDL in the United States District Court for the Southern District of New York.

Currently serves as court-appointed Indemnitees’ Liaison Counsel in global mediation of more than 100 ephedra-personal injury cases in ephedra products manufacturer’s bankruptcy proceedings before United States Bankruptcy Court for the District of New Jersey.

Coordinated and led defense mediation negotiations in multiple global mass tort mediations involving settlements of several hundred ephedra cases.

Developed and coordinated efforts to transfer hundreds of personal injury and wrongful death tort actions in numerous states and federal courts to one consolidated federal court following bankruptcy in product manufacturer.

Outside counsel for manufactured housing trade organization, retailers and community operators in federal and state zoning and federal preemption litigation, consumer complaint and commercial litigation, and taxation appeals.

Prior regional counsel for multi-state home improvement company in litigation involving sex discrimination, race discrimination, federal and state consumer finance statutes, unfair competition issues, covenant-not-to-compete and customer complaint matters.

Experienced in all phases of commercial/business litigation and employment litigation in federal and state courts, including trial, arbitration and mediation proceedings.

Registered legislative and executive branch lobbyist with extensive experience drafting and negotiating legislation before the Ohio General Assembly.
