Representative Experience

Has successfully represented the following:

  • A regional broker-dealer against allegations of breach of fiduciary duty and suitability for recommending B share mutual funds to a sophisticated businessman seeking damages in excess of $85,000.  The hearing resulted in a zero award for the Claimant.
  • Served on a legal team defending a national bank and its executives against alleged violations of federal securities laws and lending laws, resulting in state court dismissal of all claims.
  • A national broker-dealer against allegations of unauthorized trading, securities fraud, breach of fiduciary duty and failure to supervise for allegedly recommending an unsuitable investment for a profit sharing plan and joint account.
  • A regional broker-dealer against allegations of negligence, fraud, breach of fiduciary duty and failure to supervise for allegedly recommending a variable annuity and taking systematic distributions under 72(t) of the tax code.
  • A national broker-dealer against allegations of negligence and breach of fiduciary duty for allegedly failing to execute an order.  
  • A sole proprietor against a collection claim asserted by the Ohio Attorney General for unemployment contribution charges in excess of $58,000.  All claims were dismissed before trial.
