With a comprehensive background in business and complex commercial litigation, Maria offers clients substantial experience with a variety of issues that businesses commonly face, including particular expertise in securities, RICO, UCC and antitrust law. She has handled cases at the trial and appellate levels, and in federal and state court.  A former assistant attorney general in the Antitrust Bureau of the New York Attorney General’s office, she also regularly counsels clients on compliance with federal and state antitrust laws.

Representative Experience
  • Representing an insurance agency accused of conspiring to violate the antitrust laws by entering into a conspiracy to fix prices and boycott a cost-cutting competitor.
  • Obtained a dismissal of a RICO action filed against a law firm.
  • Representing a brokerage firm accused of having inadequate procedures for liquidating retirement accounts; obtained an order staying all proceedings pending arbitration.
  • Obtained a dismissal on behalf of a credit union which allegedly provided fraudulent investment advice to a customer and violated numerous federal and state laws.
  • Obtained a dismissal of RICO claims brought against two banks based on the conduct of account holders who defrauded investors out of millions of dollars.
  • Obtained a reversal, in the United States Court of Appeals for the Sixth Circuit, of a trial court order refusing to grant intervention to parties whose interests were affected by an order entered in the case.  Liberte Capital Group, LLC v. Capwill, 2005 U.S. App. Lexis 3267 (Feb. 23, 2005).
  • Achieved a favorable settlement, on behalf of a publicly traded company, of a nationwide securities fraud class action lawsuit charging that the company had made knowingly false and misleading statements about its financial condition and had purposely violated Generally Accepted Accounting Principles (“GAAP”).
  • Achieved a favorable settlement on behalf of numerous officers and directors of a publicly traded company who were defendants in a shareholder derivative suit alleging breaches of fiduciary and other duties owed to the corporation.
  • Obtained an affirmance, in the Ohio Court of Appeals, of a trial court decision dismissing with prejudice a suit against a national broker-dealer, which was accused in a nationwide class-action complaint of misleading investors in real estate limited partnerships.
  • Obtained an affirmance, in the United States Court of Appeals for the Sixth Circuit, of a district court decision dismissing a former chief financial officer of a publicly held company from a suit alleging violations of the federal securities laws.
  • Obtained a Sixth Circuit affirmance of an order enjoining the prosecution of time-barred claims in an NASD arbitration; have also handled numerous other, similar cases as well as cases seeking injunctive relief to enforce arbitration agreements.
  • Obtained summary judgment on behalf of a major telecommunications firm in a multimillion dollar breach of contract action.
  • Regularly counsels clients on compliance with federal and state antitrust laws.
  • Served as Assistant Attorney General in the Antitrust Bureau of the New York State Department of Law.
  • Former Law Clerk, U.S. District Court, Northern District of Illinois.
