Clayton focuses his practice on the Intellectual Property Practice Group.  He counsels individual and corporate clients on all aspects of patents, trademarks and copyrights.  He also prepares and prosecutes U.S. and foreign patent applications in the chemical, mechanical and business method arts.  Clay has prepared oral and written patentability, freedom to practice, non-infringement, and validity opinions.  He also has extensive experience in drafting intellectual property agreements which have involved licensing, consulting, confidentiality and settlement issues.  Clay’s patent litigation experience includes appearances in federal court and before the International Trade Commission.

Representative Experience
  • Counsel individual and corporate clients as to securement, ownership, licensing, avoidance of infringement, dispute resolution, and enforcement of intellectual property rights.
  • Prepare and prosecute patent applications before the U.S. Patent and Trademark Office in the chemical, mechanical, and business method arts.  Also coordinate filing and prosecution of PCT and foreign national patent applications.
  • Patent litigation experience in federal court and before the International Trade Commission including claim construction strategy, Markman briefings and proceedings, and expert discovery and witness preparation. 
  • Provide oral and written patentability, freedom to practice, non-infringement, and validity opinions.
  • Draft intellectual property agreements involving licensing, consulting, confidentiality, and settlement.
  • Engineering work experience includes process development related to production of specialty chemicals.
